1. WHO WE ARE

Whip Labs LLC ("FixMyWhip," "we," "us," "our") builds and sells an OBD-II scanner ("Scanner") and companion mobile application ("App"). This Policy explains how we collect, use, and share your information when you visit fixmywhip.com, place a preorder, use the Scanner, or run the App.

2. INFORMATION WE COLLECT

2.1 Information you provide

  • Name, email address, shipping address, and phone number
  • Payment details (processed securely by Stripe; we never store full card numbers)
  • Support emails and chat messages

2.2 Information we collect automatically

  • Website analytics (IP address, device type, pages viewed) via Plausible Analytics (cookie-free)
  • In-App telemetry: vehicle make/model/VIN, diagnostic trouble codes (DTCs), live sensor readings, and App usage events (feature taps, error logs)
  • Mobile device info (OS version, App version, unique device ID)

2.3 Cookies & similar tech

Our website uses a single first-party session cookie for checkout and a Plausible script that sets no cookies. No third-party ad or tracking cookies are used.

3. HOW WE USE YOUR INFORMATION

  • Process and fulfill preorders
  • Provide core Scanner + App functionality (code reading, bulletin matching)
  • Improve and debug the App and firmware
  • Send transactional emails (order confirmations, shipping updates, firmware notices)
  • Send product updates and marketing emails only if you opt in
  • Comply with legal requests and prevent fraud

4. LEGAL BASES (GDPR/UK GDPR)

We process your information on the following bases:

  • Contract - to ship your Scanner and deliver App services
  • Legitimate interests - to improve the product and protect security
  • Consent - for optional marketing emails
  • Legal obligation - for tax and bookkeeping records

5. HOW WE SHARE INFORMATION

  • Payment processor: Stripe (card processing)
  • Cloud hosting: AWS (encrypted databases & log storage)
  • With law-enforcement or regulators when legally required
  • Never sold or rented to advertisers or data brokers

6. DATA RETENTION

  • Order records: 7 years (tax purposes)
  • Diagnostic data: 2 years, or until you delete your account
  • App analytics: 24 months rolling window

You can request deletion at any time (see Section 8).

7. SECURITY

  • All traffic is encrypted (TLS 1.2+)
  • Application data is encrypted at rest (AES-256)
  • Staff access governed by least-privilege and MFA

8. YOUR RIGHTS

Depending on your location, you may:

  • Access, correct, or delete personal data
  • Export data in a machine-readable format
  • Opt out of marketing communications
  • Object to or restrict certain processing

9. CHILDREN

FixMyWhip is not directed to children under 16. We do not knowingly collect personal data from children. If you believe a child has provided us data, contact us for deletion.

10. INTERNATIONAL TRANSFERS

Data is stored in the United States. For EU/UK residents, we rely on Standard Contractual Clauses when transferring data outside the EEA/UK.

11. CHANGES TO THIS POLICY

We may update this Policy. If changes are material, we'll email you or post a notice in the App at least 7 days before they take effect.
